ARTICLE 1 – GENERAL PROVISIONS
The products of the Finca el Trueno brand are the property of the company OLIMAGINA AOVE S.L., with a share capital of 19,000 euros, whose registered office is located at calle Doctor Antonio Leiva Gámiz 11, 23193 Arbuniel (Jaén), SPAIN, registered under NIF B-23775430 – VAT no. ESB23775430 – hereinafter “OLIMAGINA S.L.”. These General Terms and Conditions of Sale (hereinafter “GTC”) apply exclusively to all sales of products or provision of services carried out by OLIMAGINA S.L. to any natural or legal person acting for their personal needs or as part of their professional or commercial activity (hereinafter the “Customer”). No other conditions shall bind OLIMAGINA S.L. except upon its written confirmation. Any other document than these GTC, including catalogs, advertisements, price lists and handwritten notes, has only an informative and indicative value, is non-contractual, and may therefore be modified by OLIMAGINA S.L. without notice. At the time of placing an order, the customer acknowledges having read these general terms and conditions of sale and accepting them without reservation.
ARTICLE 2 – OFFER
OLIMAGINA S.L. undertakes to honor the orders received subject to available stock. In the event that a product is unavailable after the order has been placed, OLIMAGINA S.L. will inform the customer by email or telephone within 48 business hours; the customer may then request the cancellation of their order and a refund of the price paid. The refund will be issued no later than 14 days after the customer's decision, by the same payment method used when placing the order.
Product illustrations are not part of the contract. They may represent suggestions for presenting the product once opened. OLIMAGINA S.L. cannot be held liable if an error has crept into the descriptions or illustrations.
ARTICLE 3 – PRICE
Prices are stated in euros, all taxes included (VAT included), excluding delivery costs. Delivery costs are indicated before payment confirmation. OLIMAGINA S.L. may change its prices at any time; products are invoiced at the price in effect at the time the order is confirmed.
ARTICLE 4 – PAYMENT
The full order is payable at the time of ordering, by credit card, Shop Pay, Apple Pay, Google Pay, PayPal or bank transfer. The order is shipped after receipt of payment.
ARTICLE 5 – DELIVERY AND TRANSPORT
OLIMAGINA S.L. delivers to mainland France, Spain, Belgium and Luxembourg. No minimum order amount is required. Delivery costs depend on the country, the delivery method and the weight of the order; they are displayed before payment. Delivery is free for purchases of €60 or more in mainland France, €49.90 or more in Spain, and €119 or more in Belgium and Luxembourg. OLIMAGINA S.L. entrusts the shipment to the carrier of its choice. It is the customer's responsibility to be able to receive their order; otherwise, it will be sent, if possible, to the nearest pickup point.
For information purposes, the delivery time is approximately 5 business days in France and approximately 3 business days in Spain from the date of shipment. In the event of a delivery delay of more than 30 days, the customer may cancel their order by simply emailing OLIMAGINA S.L.; they will then be refunded within 14 days.
ARTICLE 6 – RIGHT OF WITHDRAWAL
The consumer customer has a period of 14 days from the receipt of the products to exercise their right of withdrawal, without having to justify it, under the conditions and subject to the exceptions provided in our refund policy.
ARTICLE 7 – CLAIMS AND AFTER-SALES SERVICE
In the event of a damaged package or broken bottle upon arrival, the customer sends us a photo at contact@olimagina.com as soon as possible and we replace the product. Where possible, it is recommended to make reservations with the delivery driver at the time of delivery. These provisions do not deprive the consumer of the legal guarantees of which they benefit.
ARTICLE 8 – RETENTION OF TITLE
The transfer of ownership of the goods is suspended until full payment of the price.
ARTICLE 9 – APPLICABLE LAW AND DISPUTES
This contract is governed by Spanish law. For professional customers, the courts of Jaén have sole jurisdiction. The consumer customer retains the protection granted by the mandatory provisions of the law of their country of residence and may bring proceedings before the courts of their domicile.
